Rosalie Koolhoven deals with the Dutch right to enrichment based on the requirements of Article 6: 212 of the Dutch Civil Code, which focuses on the claim for damages. The open norm of the law of enrichment is one of the most opaque chapters of the law of obligations, especially because the relationship to the law of innocent performance in multi-party relationships is unclear - in Dutch law, as a restitution action, it is strictly separated from the claim for damages under enrichment law. The claim for damages under enrichment law establishes liability in the event of enrichment, impoverishment, a causal association between them and the lack of justification for the shifting of assets. Because the limitation of liability from the so-called ›redelijkheid‹ is rather unclear, the author investigates a total of 200 cases from case law in search of the limits of liability. In particular, the following are dealt with: the synallagmatic relationship between the constituent elements and the possible meanings of the causality requirement as well as the relationship between the claim to enrichment and the further claims in the system of free competition.
